Terms of Service

These Terms of Service govern your use of EcoFiberX internet services and associated platforms. Please read them carefully before subscribing.
1. Agreement to Terms
By subscribing to, accessing, or using any EcoFiberX service, you agree to be bound by these Terms of Service and all policies incorporated herein by reference, including our Privacy Policy, Acceptable Use Policy (AUP), and Service Level Agreement (SLA).
If you are subscribing on behalf of a business, you represent that you have authority to bind that business to these terms.
2. Services
EcoFiberX provides fibre-optic internet connectivity and related services to residential and business customers across Nigeria. The specific speed, data allowance, and features applicable to your account are set out in your chosen plan and the relevant service schedule.
We reserve the right to modify, suspend, or discontinue any service (or part thereof) with reasonable notice, except where necessary for security or regulatory compliance.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised access to your account.
One account is permitted per subscriber location. Resale of service without an active EcoFiberX Reseller Agreement is prohibited.
4. Payment & Billing
Service fees are billed monthly in advance unless otherwise agreed. Payment is due on the date specified in your invoice. We accept bank transfers, card payments, and mobile money via our payment partners.
Late payments may result in service suspension after 7 days. Accounts suspended for non-payment for more than 30 days may be terminated, with reconnection subject to a reactivation fee. All fees are quoted in Nigerian Naira (₦) and are exclusive of applicable taxes unless stated otherwise.
5. Acceptable Use
Your use of EcoFiberX services is subject to our Acceptable Use Policy (AUP), which forms part of these Terms. Activities that violate the AUP — including but not limited to network abuse, illegal content distribution, or interference with other users — may result in immediate service suspension or termination without refund.
6. Equipment
EcoFiberX-provided equipment (routers, ONUs, and cable) remains our property at all times. You are responsible for keeping the equipment safe and in good condition. Damage caused by misuse, neglect, or third-party interference is chargeable to you.
You must return all equipment within 14 days of service termination. Unreturned equipment will be charged at the current replacement cost.
7. Service Levels
We commit to the uptime and performance targets set out in our Service Level Agreement (SLA). Compensation for service failures, where applicable, is governed exclusively by the SLA and does not include consequential or indirect losses.
8. Intellectual Property
All content, software, trademarks, and materials provided as part of EcoFiberX's portals and services are the property of EcoFiberX Nigeria Ltd or its licensors. You may not copy, reproduce, modify, or distribute any such materials without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by Nigerian law, EcoFiberX's total liability for any claim arising out of or related to these Terms or our services shall not exceed the amount you paid us in the three months preceding the event giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
10. Termination
Either party may terminate this agreement with 30 days' written notice. We may terminate immediately if you breach these Terms, engage in activities that violate the AUP, or fail to pay outstanding amounts after a grace period.
On termination, access to services will cease and any prepaid amounts for unused service periods will be refunded on a pro-rata basis, less any outstanding charges.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved through good-faith negotiation or, failing that, through arbitration under the Arbitration and Conciliation Act (as amended) in Lagos, Nigeria.
12. Changes to Terms
We may revise these Terms with 30 days' notice. Material changes will be communicated by email and via the customer portal. Continued use of our services after the effective date of changes constitutes acceptance. If you do not agree, you may terminate your subscription before the changes take effect.
